根據裁判Chip Clark引用的《裁判執裁手冊》，如果進攻方和防守方同時確定了自己的位置，在這種情況下發生的犯規，必須是防守犯規（Even if they get to the spot at the same time, a tie will result in a defensive foul.）。
簡單來講——防守人必須提前占據位置，才有可能造成進攻犯規；如果防守人比進攻人遲到或者同時到，那就是防守犯規。
因此，昨天這個球，因為內史密斯沒有提前建立位置，所以是他犯規。
