6月21日,有網(wǎng)友發(fā)帖稱,自己沖泡奈雪的茶去年生產(chǎn)的小盒茶,結(jié)果喝出了青蛙尸體。當事人直言:“太惡心了,差點喝進嘴里。”
A customer's shocking experience with a Naìsnow product went viral after she posted on Saturday about finding a dead frog in her drink. The incident quickly became a trending topic on Chinese social media, drawing widespread public concern and prompting regulatory authorities to step in.
從視頻畫面可以見到,一杯差不多見底的茶里,有疑似青蛙的物體。當事人介紹,她買的是奈雪小盒茶中的茉莉花茶,里面會有些曬干的茉莉花。“那個干蛙的尸體,和這個白的(花)很像,所以你泡的時候,根本沒有辦法發(fā)現(xiàn)那只蛙?!?br/>
當事人還說,這盒花茶是去年生產(chǎn)的,當時是湊單購買的。

該網(wǎng)友后續(xù)發(fā)布的視頻顯示,她將這次涉及的產(chǎn)品以及異物提供給了奈雪。 在奈雪的一家門店里,工作人員將茶里的異物挑了出來,放在了紙巾上。奈雪方面表示,將根據(jù)《食品安全法》的相關(guān)規(guī)定,進行賠償。
In a follow-up video, the customer said she had handed over the product and the suspected foreign object to a local Naìsnow store. Store employees were seen removing the item from the teacup and placing it on a napkin for inspection. Naìsnow staff reportedly told her the company would handle the matter in accordance with China's Food Safety Law, and that compensation would be provided.
該網(wǎng)友表示,目前,市場監(jiān)督管理局已開始介入,奈雪和自己之間的事已經(jīng)處理好了,后面和自己沒有關(guān)系了。
據(jù)新民晚報,記者詢問了奈雪的茶官方客服,對方表示:“已有專人在跟進處理,目前正在核實?!?/p>
奶茶喝出異物如何維權(quán)?
曾有消費者起訴商家
去年,成都溫江法院曾公布一起案例。
2024年8月,小龐在某奶茶店購買一杯飲料,在飲用過程中發(fā)現(xiàn)該飲料中有異物,以產(chǎn)品質(zhì)量問題為由向市場監(jiān)管投訴并要求商家進行賠償。經(jīng)營者獲悉后表示愿意退款并按照小龐所購商品價格的10倍進行賠償。小龐則認為應(yīng)該按照《中華人民共和國食品安全法》第148條向其退還商品費用并賠償1000元。由于其訴求和商家的賠償限額差距過大未達成一致意見,小龐便向溫江法院提起了訴訟。
經(jīng)法院調(diào)解,最終雙方達成一致調(diào)解協(xié)議:商家向小龐支付500元賠償金并即時履行。商家表示,在今后生產(chǎn)過程中,將加強食品安全衛(wèi)生監(jiān)管,同時注重與顧客的售后溝通,避免類似事件再次發(fā)生。
The case has reignited discussion around food safety and consumer rights in China. In a similar incident from August 2024, a consumer in Chengdu, Sichuan province, found a foreign object in a milk tea and demanded compensation under China's Food Safety Law. After failing to settle with the store, the case went to court and was resolved through mediation, with the store paying 500 yuan and promising to improve hygiene and customer service.
法院提醒:消費者在購買食品時發(fā)現(xiàn)問題,應(yīng)當注意保存好發(fā)現(xiàn)問題的過程及相關(guān)證據(jù),以便于后續(xù)依法維權(quán)。在維權(quán)過程中,可以在協(xié)商和解、向服務(wù)平臺投訴、舉報、仲裁、訴訟等諸多方式中合理選擇維權(quán)手段。
根據(jù)《中華人民共和國食品安全法》第一百四十八條,消費者因不符合食品安全標準的食品受到損害的,可以向經(jīng)營者要求賠償損失,也可以向生產(chǎn)者要求賠償損失。接到消費者賠償要求的生產(chǎn)經(jīng)營者,應(yīng)當實行首負責任制,先行賠付,不得推諉;屬于生產(chǎn)者責任的,經(jīng)營者賠償后有權(quán)向生產(chǎn)者追償;屬于經(jīng)營者責任的,生產(chǎn)者賠償后有權(quán)向經(jīng)營者追償。
China's Food Safety Law states that consumers harmed by unsafe food can claim compensation from either the seller or producer, with whoever is contacted obligated to take responsibility and provide initial compensate. This responsible party can later recover losses from the other organization.
Courts advise consumers to keep evidence like photos or receipts and pursue claims through negotiation, complaints, or legal action.
