近日,針對山東臨沂蘭山區一飯店因拍攝發布菜品視頻被認定為“違法廣告”,并面臨高額處罰一事,臨沂市高度重視,對此事件進行提級調查。7月15日,臨沂市聯合調查組發布情況通報。
Authorities in Linyi, Shandong province, have launched an investigation after a restaurant in Lanshan district faced a large potential fine for allegedly posting an illegal food advertisement online.
經調查,蘭山區市場監督管理局在執法辦案過程中,存在以下問題:一是處罰證據不足。僅憑當事人發布的視頻照片作出處罰告知,事實不清。二是執法程序不當。當事人提出聽證申請后未按規定組織聽證;在作出不予處罰決定后,未按規定期限送達書面《不予行政處罰決定書》。
針對以上問題,由市市場監督管理局按程序對該行政執法行為予以撤銷,對蘭山區市場監督管理局時任黨組書記齊某進等五名相關工作人員作出停職處理。后續將對此事件繼續調查,根據調查結果依規依紀依法嚴肅處理。責成蘭山區市場監督管理局深刻汲取教訓,舉一反三,進一步規范行政執法行為,堅決避免類似事件再次發生。
According to a statement released on Tuesday, the Lanshan District Administration for Market Regulation was found to have mishandled the case, citing insufficient evidence and procedural violations — including failure to organize a hearing and issue official documents on time.
As a result, the city revoked the enforcement action and suspended five officials involved. Further investigation is ongoing, and officials pledged to prevent similar incidents by strengthening law enforcement procedures.
據此前報道,今年3月,在山東省臨沂市開飯店的張老板收到一份由蘭山區市場監督管理局出具的行政處罰告知書。告知書載明,因她發布法律禁止行為的廣告,擬被罰款45萬元。

初步調查顯示,2025年2月15日,當事人涉嫌在網絡發布使用國家禁止食用的動物蛤蟆(中華蟾蜍)加工菜品的視頻。3月17日,蘭山區市場監管局立案調查,并于3月24日下達《行政處罰告知書》。3月27日,當事人向蘭山區市場監管局提交了陳述申辯相關資料,并主動刪除相關視頻。5月12日,蘭山區市場監管局綜合具體事實和危害程度,決定不再作出行政處罰并告知當事人。
According to previous reports, in March, the restaurant owner, surnamed Zhang, received notice of a potential 450,000 yuan fine. She later deleted the video and submitted a statement. By May, local regulators decided not to impose the fine, citing the facts and limited harm.

7月11日,張老板表示,該處罰因飯店一道菜品“蛤蟆湯”的小視頻而起。她介紹,菜品原料為牛蛙,當地風俗一般稱牛蛙為“蛤蟆”,自己不過是將記錄飯店日常的小視頻隨手發在網上,“根本算不上廣告”,卻因此要被罰款45萬元,這讓她難以接受。
Authorities initially suspected the dish involved a protected species, the Asiatic toad. However, Zhang said the soup was made with bullfrog — a legal ingredient — and explained that "toad" is a local nickname for bullfrog. She claimed the short video was casually posted and not intended as an advertisement.
同日,蘭山區市場監督管理局廣告監督管理科相關工作人員稱,涉事飯店老板發布的視頻涉及“蛤蟆”,而蛤蟆是野生保護動物,若“蛤蟆湯”用的是牛蛙,需明確寫明是牛蛙。如果飯店在短視頻平臺分享產品或者制作過程展示,且賬號名稱和店鋪名字一致,就構成商業廣告。
Officials explained that sharing product videos under a business account may be considered advertising. They also stressed that ingredients like bullfrog must be clearly labeled to avoid confusion with protected species.
