案情回顧

2019年初，江西省宜春市萬載縣王某某在外地打工認(rèn)識一名福建人（姓名不詳），知道他能收碼購買六合彩并進(jìn)行返利，便加了微信。2023年1月至7月期間，被告人王某某通過微信將號碼和賭資發(fā)給這名福建人，開始為同村以及附近村子二十余人“寫碼”（代為購買地下六合彩）下注購買六合彩，并發(fā)展了歐某某、林某某為下線“寫碼”，從中賺取返利，獲利2萬余元。截至案發(fā)，共有60余名村民在王某某等人處下注購買六合彩進(jìn)行賭博，涉及賭博資金50余萬元。

被告人王某某等人以營利為目的，通過設(shè)立微信群組“代買六合彩”的方式組織多人進(jìn)行賭博，其行為觸犯了《中華人民共和國刑法》第三百零三條規(guī)定，應(yīng)當(dāng)以開設(shè)賭場罪追究刑事責(zé)任。王某某等3人最終被法院判處有期徒刑七個月至一年六個月不等。

《中華人民共和國刑法》第三百零三條第二款：

開設(shè)賭場的，處五年以下有期徒刑、拘役或者管制，并處罰金；情節(jié)嚴(yán)重的，處五年以上十年以下有期徒刑，并處罰金。

組織中華人民共和國公民參與國（境）外賭博，數(shù)額巨大或者有其他嚴(yán)重情節(jié)的，依照前款的規(guī)定處罰。

“地下六合彩”是利用香港六合彩開獎號碼作為中獎依據(jù)，讓參賭人參與“買碼”對賭的一種非法私彩，即以香港地區(qū)的六合彩號碼為名頭，實際上是一種虛假、非法的私人坐莊的賭博活動，參賭者十賭九輸。“地下六合彩”的“高賠率”讓參賭人員深陷其中無法自拔，且該類賭博隱蔽性強，資金流轉(zhuǎn)迅速，賭資數(shù)額巨大，社會危害突出。
