A seemingly conscientious act caught on camera in Xiangyang city, Hubei province has ignited an online debate about the legal boundaries of drunk driving avoidance.
On the evening of June 11 around 9 pm, a local resident identified as a woman surnamed Lei witnessed an unusual sight of three men strenuously pushing a sedan down Fanwei Road, a short road in the city's Fancheng district. Believing this demonstrated a commendable effort to "avoid drunk driving", Lei recorded the scene and shared the video on social media. Her post quickly attracted significant public attention and discussion.
那么,酒后推車算酒駕嗎?
當地交警調看沿途監控發現,三位男子推行一輛小型汽車,從鄧城大道輔路右轉至樊魏路,經桃園路路口后,在樊魏路一汽修店附近停下。全程接近500米。
Following the online buzz, local traffic police reviewed surveillance footage from the area. The investigation revealed that the trio pushed the vehicle from the service road of Dengcheng Avenue, turning right onto Fanwei Road. They continued past the intersection of Taoyuan Road before stopping near an auto repair shop on Fanwei Road. The car was pushed a total distance of approximately 500 meters.
從監控中看,一男子在駕駛位外側手扶方向盤推車,另外兩名男子在車后推車,沒有人坐在駕駛位上,不屬于傳統意義上的駕駛行為。同時,行為人推車的行為也能證明相關人員主觀上明知酒后不能駕車,而選擇替代性的推車方式,不具有酒后駕車的主觀故意,也不符合車輛處于行駛狀態,不能認定為酒駕。
但是應當注意,根據《中華人民共和國道路交通安全法》第三十一條規定,未經許可,任何單位和個人不得占用道路從事非交通活動。視頻中的推車行為發生在機動車道及機非混行道路上,存在“占用道路從事非交通活動”違法行為。這種行為不僅妨礙交通、影響其他車輛通行,還有可能使自己的人身安全受到威脅。如果在推車過程中發生了交通事故,也是屬于機動車交通事故。
Authorities clarified this does not qualify as traditional driving behavior. The absence of subjective intent to operate the vehicle while intoxicated, combined with the car not being in a powered motion state, means the action cannot be legally classified as drunk driving.
However, police emphasized the act violates Article 31 of China's Road Traffic Safety Law, which prohibits occupying roads for non-traffic activities without authorization. By pushing the car along a motor vehicle lane and mixed-use roadway, the group committed the offense of "occupying a road for non-traffic activities". This behavior poses multiple hazards: it obstructs traffic flow and impedes other vehicles; it endangers the safety of those pushing the vehicle. Critically, any accident occurring during such pushing would be legally classified as a motor vehicle traffic accident, carrying full associated liabilities.
