近日，拱北海關(guān)所屬港珠澳大橋海關(guān)連續(xù)查獲3起出口跨境電商侵權(quán)貨物案，共查獲侵犯泡泡瑪特品牌商品20599件。

6月12日凌晨1時(shí)，在港珠澳大橋珠海公路口岸出境貨運(yùn)查驗(yàn)場(chǎng)，現(xiàn)場(chǎng)關(guān)員對(duì)一輛轉(zhuǎn)關(guān)出口的跨境貨車進(jìn)行機(jī)檢查驗(yàn)時(shí)，發(fā)現(xiàn)一批灰棕色紙箱里裝有大量盲盒及毛絨玩具，共計(jì)10465件。

The Gongbei Customs in Guangdong province on June 12 uncovered 20,599 counterfeit Labubu, a top seller in Pop Mart products, including blind-box toys and plush figures, during three separate inspections of outbound transshipment trucks at the Hong Kong-Zhuhai-Macao Bridge Customs checkpoint, according to the General Administration of Customs on Wednesday afternoon.

其中部分外包裝上印有“POP MART”（泡泡瑪特）的品牌標(biāo)識(shí)，其他商品均無品牌標(biāo)識(shí)，但外形IP均為泡泡瑪特當(dāng)前最熱門的LABUBU系列。關(guān)員現(xiàn)場(chǎng)初步判斷該批盲盒及毛絨玩具涉嫌侵權(quán)。

Many of the items closely resembled characters from Pop Mart's popular Labubu series, but most lacked proper trademark labels.

當(dāng)日14時(shí)、20時(shí)，關(guān)員連續(xù)查獲2輛裝運(yùn)印有“POP MART”品牌標(biāo)識(shí)盲盒及毛絨玩具的轉(zhuǎn)關(guān)出口跨境貨車，分別有7734件、2400件。經(jīng)清點(diǎn)，三批貨物共計(jì)有20599件。

經(jīng)權(quán)利人確認(rèn)，上述盲盒及毛絨玩具均未經(jīng)授權(quán)使用“POP MART”（泡泡瑪特）的標(biāo)識(shí)，侵犯了其商標(biāo)權(quán)和著作權(quán)。權(quán)利人已依法向海關(guān)申請(qǐng)知識(shí)產(chǎn)權(quán)保護(hù)，目前，該批貨物已按規(guī)定作進(jìn)一步處理。

Following confirmation from the intellectual property rights holder, the seized goods were deemed to have unauthorized use of the company's trademark and copyrighted character designs, violating its legal protections.

The holder has formally applied for customs protection, and the cases are currently under further legal process, it said.

海關(guān)提醒：

• 根據(jù)《中華人民共和國(guó)海關(guān)法》規(guī)定，進(jìn)出口貨物收發(fā)貨人及其代理人應(yīng)當(dāng)按照規(guī)定向海關(guān)如實(shí)申報(bào)貨物有關(guān)知識(shí)產(chǎn)權(quán)狀況，并提交合法使用有關(guān)知識(shí)產(chǎn)權(quán)的證明文件；

• 違法進(jìn)出口侵犯中華人民共和國(guó)法律、行政法規(guī)保護(hù)的知識(shí)產(chǎn)權(quán)的貨物的，由海關(guān)依法沒收侵權(quán)貨物，并處以罰款；

• 構(gòu)成犯罪的，將依法追究刑事責(zé)任。

Customs authorities have reminded exporters and their agents that, under China's Customs Law, all goods must be truthfully declared, including their intellectual property status. Documentation proving legal use of trademarks or copyrighted designs must be submitted when required.

Infringing goods are subject to confiscation and fines. In severe cases, criminal charges may be pursued in accordance with the law, the authorities added.
